Chonkie, Inc. (“Chonkie,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect information when you visit chonkie.ai, contact us, or work with us for post-training, model development, evaluation, data engineering, deployment, and related services.

This Policy is intended to be practical and readable. It does not replace any written agreement, statement of work, data processing addendum, business associate agreement, or other customer agreement we sign with you. If a signed agreement says something different about customer data, that signed agreement controls. These terms should be read together with our Terms of Service, as applicable.

Information We Collect

We collect information in a few ways.

Information you provide

You may give us:

• contact information, such as name, email address, company, role, and phone number;
• communications, such as emails, meeting notes, demo requests, support requests, and feedback;
• billing and administrative information needed to manage an engagement;
• information you choose to provide when discussing or scoping work with us.

Customer service data

When we work with a customer, the customer may provide data needed to perform the engagement. Depending on the project, this may include prompts, outputs, logs, documents, datasets, evaluations, annotations, metadata, code, configuration, model artifacts, deployment information, and other business or technical materials.

We call this “Customer Data” in this Policy. Customer Data is handled according to the applicable customer agreement. We use Customer Data to provide the services, improve or evaluate the specific systems we are engaged to work on, troubleshoot issues, maintain security, and satisfy legal or contractual obligations.

We do not use Customer Data to train shared, general-purpose, or third-party models unless the customer agrees to that use in writing.

Information collected automatically

When you visit our website, we and our service providers may collect limited technical information, such as IP address, browser type, device information, referring page, pages viewed, approximate location derived from IP address, and interaction data. We may use cookies or similar technologies for basic website functionality, analytics, security, and performance.

How We Use Information

We use information to:

• operate, secure, and improve our website;
• respond to inquiries and communicate with you;
• evaluate whether Chonkie can help with a project;
• provide, manage, and improve services for customers;
• build, evaluate, fine-tune, deploy, or operate customer-specific systems as authorized by the customer;
• prepare proposals, statements of work, invoices, and administrative records;
• monitor abuse, prevent fraud, and protect Chonkie, customers, and others;
• comply with legal, tax, accounting, and contractual obligations;
• send updates about Chonkie where permitted by law.

You may opt out of marketing emails by using the unsubscribe link in the email or by contacting us.

How We Share Information

We do not sell personal information. We do not share personal information for cross-context behavioral advertising.

We may share information with:

• service providers and contractors who help us host, operate, secure, analyze, or provide our website and services;
• cloud, infrastructure, model, observability, security, collaboration, and communication providers used to perform customer work;
• professional advisors, such as lawyers, accountants, auditors, and insurers;
• parties involved in a merger, acquisition, financing, reorganization, or sale of assets;
• law enforcement, regulators, courts, or others when we believe disclosure is required by law or necessary to protect rights, safety, or security;
• other parties with your consent or at your direction.

When customer work requires third-party infrastructure or model providers, we use those providers only as needed to perform the engagement or as otherwise authorized by the customer.

Customer Data and Ownership

As between Chonkie and the customer, customers retain their rights in the materials they provide to us. Chonkie retains its rights in our pre-existing tools, methods, know-how, software, templates, libraries, and general expertise.

Ownership of deliverables, model artifacts, code, datasets, evaluations, and other work product should be handled in the applicable written customer agreement.

Data Retention

We keep information for as long as reasonably necessary for the purposes described in this Policy, including to provide services, manage customer relationships, comply with legal obligations, resolve disputes, enforce agreements, maintain security, and keep business records.

Customer Data retention may be governed by the applicable customer agreement. We can delete or return Customer Data as agreed in writing.

Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information. No method of transmission or storage is perfectly secure, so we cannot guarantee absolute security.

The Federal Trade Commission advises businesses to understand what personal information they hold, keep only what they need, protect it, dispose of it properly, and plan for incidents. We use those principles as practical guidance for our security program.

Your Choices and Rights

Depending on where you live, you may have rights to request access, correction, deletion, portability, restriction, or objection to certain processing of your personal information. You may also have the right to opt out of certain sharing or marketing communications.

California residents may have rights under the California Consumer Privacy Act, including the right to know what personal information is collected, used, shared, or sold; the right to delete personal information; the right to correct inaccurate personal information; the right to opt out of sale or sharing; the right to limit use of sensitive personal information; and the right not to be discriminated against for exercising privacy rights.

We do not sell personal information or share it for cross-context behavioral advertising. If that changes, we will update this Policy and provide any required notices or choices.

To make a privacy request, contact us at support@chonkie.ai. We may need to verify your identity before responding. If your information was provided to us by a customer in connection with a customer engagement, we may direct your request to that customer.

Your California Privacy Rights

Chonkie does not sell, trade, or otherwise transfer to outside third parties your “Personal Information” as the term is defined under California Civil Code Section 1798.82(h), except as described in this Privacy Policy or as authorized by you or the applicable customer agreement.

California Civil Code Section 1798.83 permits California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, or to request access to, correction of, or deletion of Personal Information that we store about you, please email support@chonkie.ai.

If we delete Personal Information as requested, we may no longer be able to provide certain services to you or the applicable customer. We may also retain information as needed for security, legal compliance, dispute resolution, billing, recordkeeping, or other lawful business purposes.

California Consumer Privacy Act

This section supplements the information above and applies to California residents where the California Consumer Privacy Act, as amended (“CCPA”), applies.

Under the CCPA, California residents may have the right to:

• know the categories and specific pieces of Personal Information we have collected about them;
• know the categories of sources from which Personal Information is collected;
• know the business or commercial purposes for collecting, using, sharing, or disclosing Personal Information;
• know the categories of third parties to whom we disclose Personal Information;
• request deletion of Personal Information, subject to exceptions;
• request correction of inaccurate Personal Information;
• opt out of the sale or sharing of Personal Information;
• limit the use and disclosure of Sensitive Personal Information where applicable;
• not be discriminated against for exercising CCPA rights.

We do not sell Personal Information. We do not share Personal Information for cross-context behavioral advertising. We do not knowingly sell or share Personal Information of individuals under 16 years of age.

For your information, we may collect or process the following categories of Personal Information: identifiers such as name, email address, employer, role, phone number, IP address, and online identifiers; commercial and professional information; internet or other electronic network activity information; communications with us; and business or technical information provided in connection with a customer engagement.

We use this information for the purposes described in this Privacy Policy, including to provide services, respond to inquiries, manage engagements, maintain security, comply with law, and improve our website and services.

Other State Privacy Rights

This Privacy Policy explains how we collect, use, and disclose Personal Information. This section describes how to exercise rights under various state privacy laws where those laws apply.

Residents of states with applicable privacy laws, including Colorado, Connecticut, Utah, Virginia, and other states, may have rights to confirm whether we process Personal Information, access Personal Information, correct inaccuracies, delete Personal Information, obtain a portable copy of Personal Information, and opt out of certain processing, including targeted advertising, sale, or profiling in furtherance of decisions that produce legal or similarly significant effects.

Massachusetts residents may also have rights under Massachusetts data security laws to request access to, correction of, or deletion of Personal Information, and to receive notice in the event of certain data breaches.

To exercise any state privacy right, please email support@chonkie.ai. If your information was provided to us by a customer in connection with a customer engagement, we may direct your request to that customer.

If we delete Personal Information as requested, we may no longer be able to provide certain services to you or the applicable customer. We may retain information as permitted by law for security, legal compliance, dispute resolution, billing, recordkeeping, or other lawful business purposes.

International Transfers

Chonkie is based in the United States. If you access our website or work with us from outside the United States, your information may be processed in the United States and other countries where we or our service providers operate.

COPPA Compliance

The Children’s Online Privacy Protection Act (“COPPA”) applies to entities that collect and store Personal Information from children under the age of 13. Our website and services are not directed to children under 13, and we do not knowingly collect Personal Information from children under 13. If you believe a child under 13 has provided us Personal Information, please email support@chonkie.ai and we will take appropriate steps.

If you are under 13, please do not access or use our website or services.

Do Not Track

Some browsers send “Do Not Track” signals. There is no common industry standard for how websites should respond to those signals, so our website does not currently respond to them.

CAN-SPAM Act

The CAN-SPAM Act establishes requirements for commercial messages and gives recipients the right to have businesses stop emailing them. As and when applicable, we will comply with the CAN-SPAM Act. We will not use false or misleading subjects or email addresses, we will identify commercial email as required by law, we will honor opt-out and unsubscribe requests promptly, and we will monitor third-party email marketing services for compliance if one is used.

Modifications to Our Privacy Policy

We may update this Privacy Policy from time to time. We will post any changes on this page. If we make material changes, we will provide notice as required by law or by our customer agreements. If you continue to use our website or services after changes are posted, you are bound by the updated Privacy Policy to the extent permitted by law.

Anti-Bribery Compliance

Chonkie represents that it is aware of and intends to comply with applicable anti-bribery and anti-corruption laws, including the U.S. Foreign Corrupt Practices Act, the U.K. Bribery Act, the India Prevention of Corruption Act of 1988, and other applicable anti-bribery statutes and regulations. Chonkie will not offer, promise, make, authorize, or provide any contribution, thing of value, gift, or other payment to any government official, political party, state-owned enterprise, public international organization, or representative of such person for the purpose of influencing an act or decision, securing an improper advantage, or obtaining or retaining business.
